Chapter I General Provisions
Article 1 These Regulations are formulated in order to implement the " Regulations on the Administration of Urban House Demolition
" (hereinafter referred to as the "Regulations"), taking into account the actual conditions of the autonomous region.
Article 2. Those who carry out house demolition on state-owned land in the urban planning area of the autonomous region and need compensation and resettlement for the demolished shall abide by these rules.
The house demolition referred to in these Detailed Rules refers to acts of the demolisher in mobilizing the demolished person, organizing the signing and implementation of the demolition compensation and resettlement agreement, and organizing the demolition of the house and its accessories.
The “houses” mentioned in these Detailed Rules refer to various types of house buildings and their supporting pipelines and equipment.
The “house attachments” mentioned in these rules refer to buildings, structures and other valuable attachments within the scope of the land for housing.
Article 3 The administrative department of construction of the autonomous region shall supervise and manage the demolition of urban houses within its own administrative region.
The departments of the prefecture, city (prefecture) and county (city) people's governments responsible for the management of house demolition work shall supervise and manage urban house demolition work within their respective administrative areas.
The land administrative department of the people's government at or above the county level is responsible for land management related to urban house demolition in accordance with relevant laws and regulations.
Chapter II Demolition Management
Article 4 When applying for a house demolition permit, the demolisher shall provide relevant materials in accordance with the provisions of the Regulations. Among them, the demolition plan and the demolition plan shall specify the following matters:
(1) Basic information of the construction project;
(2) Relocation scope, relocation method, relocation time, relocation period;
(3) the status of the demolished house;
(4) The area expected to be compensated by monetary compensation and property rights swap, and the estimated budget for compensation and resettlement funds;
